7 CFR § 273.11(n)(4)
Verify the individual’s status as a fleeing felon or a probation or parole violator before disqualifying them for SNAP.
Law enforcement requests for information do not verify the status of the felony warrant or probation or parole violation status.
Verify the status of a felony warrant or probation or parole violation only if a law enforcement agency presents a felony arrest warrant, or states intent to arrest an individual for probation or parole violation.
Request the following status information from the law enforcement agency:
- the conditions of a felony warrant or a probation or parole violation, and
- whether the law enforcement agency intends to actively seek the individual.
Allow the law enforcement agency 20 days to respond to a status information request.
If the law enforcement agency intends to enforce the felony warrant, or arrest the individual for a probation or parole violation within 30 days of the date of the status request,
- delay any actions on the case until the 30-day period ends, and
- verify with the law enforcement agency if an attempt was made to execute the felony warrant or arrest the probation or parole violator.
- Deny or end the individual’s eligibility if action was taken within the 30 days.
- The individual is not a fleeing felon or probation or parole violator if no action was taken within the 30-day period.
