Fleeing Felon/Probation or Parole Violator Status
7 CFR § 273.11(n)(1)(ii) and (2)-(5)
An individual is a fleeing felon or a probation or parole violator if they meet the following criteria.
Fleeing Felon
7 CFR § 273.11(n)(1)(i)
An individual is a fleeing felon if a law enforcement officer presents a felony arrest warrant to obtain the location and other information about the individual. The felony warrant must contain one of the following National Crime Information Center Uniform Offense Classification Codes:
- Escape (4901);
- Flight to Avoid (prosecution, confinement, etc.) (4902); or
- Flight-Escape (4999).
Probation Violator
7 CFR § 273.11(n)(2)
An individual is a probation violator if:
- a Court of law rules that the individual violated a condition of their probation ordered under a Federal or State law, and
- local law enforcement is actively seeking the individual to enforce the conditions of the probation.
Parole Violator
7 CFR § 273.11(n)(2)
An individual is a parole violator if:
- the Connecticut Department of Corrections, Parole Board (for state offenses) or a Court of law (for Federal offences) rules that the individual violated a condition of their parole ordered under a Federal or State law, and
- local law enforcement is actively seeking the individual to enforce the conditions of the parole.
Noncompliant Convicted Felons
2014 Farm Bill – Section 4008
Individuals who have been convicted of certain crimes and are not in compliance with the terms of their sentence are ineligible for SNAP benefits. These crimes are:
- aggravated sexual abuse under section 2241 of title 18
- murder under section 1111 of title 18
- an offense under chapter 110 of title 18
- a Federal or State offense involving sexual assault, as defined in section 40002(a) of the Violence Against Women Act of 1994
- an offense under State law determined by the Attorney General to be substantially similar to title 18 crimes listed above.
Individuals who are not in compliance with their sentence are considered disqualified members.
Actively Seeking
7 CFR § 273.11(n)(3)(i)-(iii)
Actively seeking means a Federal, State, or local law enforcement agency:
- states an intent to enforce an outstanding felony warrant, or arrest an individual for a probation or parole violation within 20 days of the date the law enforcement agency requested information about the individual;
- presents a felony arrest warrant; or
- states an intent to enforce an outstanding felony warrant, or arrest an individual for probation or parole violation within 30 days of the date of a status information request about a specific warrant/violation from DSS.
An individual is not a fleeing felon or a probation or parole violator if the law enforcement agency does not intend to enforce the felony warrant or to arrest the individual for a probation or parole violation within 30 days of the status information request from DSS.
