Debts Owed to an EDG - 7 CFR § 273.9(b)(2)(v) - Exclude the principal portion of payments made to the EDG to repay a loan or promissory note.

       

Count any interest paid as unearned income. 


Difficulty of Care Payments -  7 CFR § 273.1(b)(4), 7 CFR § 273.9(c)(15)  - See Adult Family Living Payments. 


Disability Benefits - 7 CFR § 273.9(b)(2)(ii) - Count the disability benefits as unearned income if:

  • the person is no longer an employee regardless of the source of the payment, or 
  • the person is an employee but is not paid out of the employer’s funds.

Example: Funds paid through an insurance policy.


Count the disability benefits as earned income when:

  • the funds are paid from the employer, and   
  • the individual is still an employee of the company.


Disaster Assistance - 7 CFR § 273.9(c)(10) - Exclude disaster and emergency assistance payments provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended by Public Law 100-707.


This exclusion applies to federal assistance provided to individuals directly affected and to comparable disaster assistance provided by states, local government, and disaster assistance organizations. 


Most Federal Emergency Management Agency (FEMA) funds are excluded.  However, payments made to homeless individuals to pay rent, mortgage, food and utilities are not excluded under this provision when there is no major disaster or emergency declared by the President.


Dividend Income - 7 CFR § 273.9(b)(2)(vi) - Count as unearned income in the month received.


Count as unearned income dividends from trust funds that the EDG has the option of either receiving as income or reinvesting in a trust or other investment. 


Domestic Volunteer Services Act of 1973 (P.L. 93-113, as amended) Title II Payments - 7 CFR § 273.9(b)(1)(iv) - Exclude all payments under Title II, including those made through the: 

  • Elderly Companion, 
  • Foster Grandparents, 
  • National Elderly Service Corps, including the Retired and Elderly Volunteer Program (RSVP), and others.
