Fair Hearings Regarding Claims
7 CFR § 273.18(e)(6)(i)-(iii)
The Agency’s representative is notified when a hearing is requested regarding a claim. The claim is suspended until the fair hearing decision is received.
Claims waiting a fair hearing decision are not delinquent.
When the fair hearing decision is reached, the Agency’s representative will:
- delete the claim if the EDG is upheld, or
- re-establish the claim and re-notify the EDG, if the claim is upheld.
