Ineligible Non-Citizen
7 CFR § 273.2(f)(2)(ii) & 7 CFR § 273.4(a) and (b)(2) & 7 CFR § 273.11(c)(3)
Ineligible non-citizens are not eligible for SNAP. They include:
- Immigrants not identified as eligible non-citizens.
- Non-immigrants.
Exclude any EDG member whose non-citizen status is in question, because of an inability or unwillingness to attest to their non-citizen status. Take no further action to get verification of their status.
Ineligible non-citizen EDG members must cooperate in establishing eligibility for eligible EDG members by answering questions and providing verification of their:
- income,
- assets, and
- expenses and deductions.
Deny the EDG if the ineligible non-citizen fails to answer questions or provide required verification needed to determine the EDG’s eligibility.

Reporting Known Undocumented Non-Citizen
7 CFR § 273.4(b)
Undocumented status is “known" only when a formal determination, subject to administrative review, was completed and is supported by the Department of Homeland Security (DHS) or the Executive Office for Immigration Review, such as a Final Order of Deportation.
Report and send a copy of the formal determination to a PA Consultant in the Economic Security Unit in Central Office when a known undocumented non-citizen applies for SNAP benefits. Do not report the non-citizen as an undocumented non-citizen without a formal determination.
Central Office will report the individual to the USCIS.
Undocumented non-citizens are ineligible for SNAP benefits.
