7 CFR § 273.15(j)(2)


Hearings are reinstated one time for the following reasons:

  • EDGs and their authorized representative request to have their withdrawn hearing request reinstated.  The EDG must request to reinstate their hearing within 10 days of receipt of the withdrawal acknowledgment confirming the EDG’s withdrawn hearing request.  
  • OLCRAH determines the EDG/authorized representative had good cause for not requesting a hearing timely.
