7 CFR § 273.8(h)(1)


Transfer of an asset occurs when the interest in property is given to another individual, or disposed of in another way.  


Transferred countable assets must meet the allowable transfer policy for the EDG to remain eligible for SNAP. Ineligible transfers of assets means the EDG transferred the asset to remain eligible for SNAP.  Ineligible transfers of assets disqualifies the entire EDG for up to 12 months.  

Allowable Transfers

Allowable asset transfers are those that:

Exception:  This allowable reason does not apply to asset transfers by EDGs that are RCE because of receipt of SAGA or AABD.

  • involve the transfer of an asset that is sold or traded at or near fair market value;
  • involve the transfer of an asset between members of the EDG, including ineligible and disqualified individuals;
  • are made for reasons other than to qualify or attempt to qualify for SNAP, such as putting money in a trust fund; or
  • would not affect eligibility, such as the transfer of excluded personal property.

Ineligible Transfers

7 CFR § 273.8(h)(1) and (3)


Ineligible asset transfers occur:

  • at application if:
    • assets are transferred within the 3-month period before the date of applying for SNAP benefits, and
    • the transfer was done solely to qualify for SNAP benefits, or
  • during the current certification period if done solely to remain eligible for SNAP benefits.

Determining the Disqualification Period

7 CFR § 273.8(h)(3)-(4)


Applicant EDGs’ disqualification period begins the month of application.


Active EDGs’ disqualification period begins the month following the month the advance notice expires, unless the EDG requested:


Follow these steps to determine the disqualification period:

  1. Add the value of the countable transferred assets to the value of the EDG’s other countable assets.
  2. Subtract the appropriate asset limit for the EDG from the amount in Step One.  
  3. Compare the result to the Disqualification Period Table to determine the period the EDG is disqualified from receiving SNAP benefits.


Notify the EDG of their disqualification, and how long the disqualification will last.
