Agency Error

Underpayments due to agency error occur when the agency failed to provide the EDG with the correct amount of benefits.  

Application Delay or Denial 

7 CFR § 273.17(d)(1)(i) and (ii)


Restore benefits when the application was: 

  • denied in error, or
  • not processed timely.

Case Closed in Error

Restore benefits for cases closed in error.

Incorrect Amount

7 CFR § 273.17(d)(1)


Restore benefits if the EDG received less benefits than it was eligible for.

Overpaid Claims

7 CFR § 273.18(h)


Restore benefits when the EDG pays more on a claim than required, or when the system recoups too many benefits on a claim. 

Exception:  Do not restore benefits when the claim was reduced using expunged benefits. 

Renewal Delay or Denial 

7 CFR § 273.17(d)(1)(i)


Restore benefits when a timely renewal application was:

  • denied in error, or 
  • not processed timely.


Changes in State or Federal Laws or Regulations

7 CFR § 272.1(g) & 7 CFR § 273.17(a)(1)


Restore any underpaid benefits when required and directed by State or Federal laws or regulations.

Denied EDG Becomes Categorically Eligible

7 CFR § 273.2(j)(1)(iv) and (k)

 

Restore benefits to denied EDGs that become categorically eligible and SNAP eligible due to AABD, SAGA, SSI, or TFA approval.

Fair Hearing Decision 

7 CFR § 273.17(a)(1) and (2) and (c) and (e)


Restore underpaid benefits when a fair hearing decision states the agency’s actions regarding the EDG’s benefit amount or eligibility were incorrect.

Judicial Action

7 CFR § 273.17(a)(2)


Restore benefits when any judicial action finds benefits were wrongfully withheld. See Timeframes – Judicial Action for the appropriate restoration period.

Reversed IPV Determination 

7 CFR § 273.17(a)(1) and (e)


If a IPV is reversed on appeal to CT Superior Court: 

  • restore benefits that were underpaid due to the IPV disqualification, and
  • refund any payments made on the IPV claim, see Overpayments and Claims.

SSA Error 

7 CFR § 273.2(k)(1)(i)(F) and (iii)(E)


Restore benefits for errors made by SSA in the handling of joint SSI and SNAP applications. See Timeframes – SSA Error for the appropriate restoration period.
